Milingo Lungu challenges his re-arrest in Concourt

Former Konkola Copper Mines Provisional Liquidator Milingo Lungu has gone to the Constitutional Court seeking a declaration that his re-arrest and criminal proceedings against having been granted immunity by the Director of Public Prosecution in matters relating to his performance as Provisional Liquidator of KCM is an abuse of criminal proceedings and ultra vires to articles 180(7) and 2016(c) of the Constitution.

Mr. Lungu wants the Constitutional Court to retrain the Attorney General as First Respondent, Investigating Officer Boyd Munalula as Second Respondent, and the dec as third respondent from investigating, arresting and prosecuting him in respect of his performance as provisional liquidator.

He also wants an order directing the attorney to remove into court and quash the second and third respondents’ decision to charge and arrest him on 7th April 2022 for theft, and money laundering of k4.4million belonging to KCM.

Mr. Lungu is also demanding damages.

He has argued that as creditor he exercised a lien on the assets of KCM by transferring monies belonging to KCM to Lungu Simwanza and Company clients account to secure the debt owed to him pending reconciliation of the statement of account between KCM and himself.
