The matter in which Lusaka lawyer Kelvin Zimba has sued minister of health Sylvia Masebo in the Lusaka high court for directing that only vaccinated people against the covid-19 virus should be allowed access to government buildings has failed to take off following the absence of other parties to the case.

in this matter Kelvin Zimba of messers mosha and company advocates, wants the court to declare that the pronouncements made by the minister on November 28, 2021 demanding that all persons entering public buildings and public service workers must be vaccinated against covid-19 and must produce certificate of vaccination is against the constitution of Zambia.

He argues that the minister has contravened articles 13, 19, 21 and 22 of the Zambian constitution and therefore, her directives must be declared null and void.

The matter has been allocated to a panel of three constitutional court judges but when it came up for trial, the matter was held chambers where it has been adjourned to a date to be communicated.

The minister of health directed that beginning Tuesday, November 30, it will be a requirement for all persons to provide evidence of vaccination before entry into government buildings and that as a stringent measure to curb the omicron variant of covid 19, it will be a requirement for civil and public servants to be vaccinated for them to be admitted at work.
