Speaker declares Kambwili’s roan seat vacant

Speaker of the National Assembly Patrick Matibini has declared the Roan parliamentary seat which was held by National Democratic Party Consultant Chishimba Kambwili vacant.

This follows a point of order raised by Eastern province Minister Makebi Zulu on 21st February, 2019 whether Mr Kambwili was in order to cross the floor by being a member of the National Democratic Congress party while still remain a member of the parliament under the PF under whose ticket he was elected to the National Assembly.

Delivering a ruling on the point of order, Dr. Matibini ruled that Mr Kambwili had crossed the floor of the house by virtue of assuming the position of NDC consultant.

Dr. Matibini CITED Articles 72(2) d and (2) g of the constitution which state that a member of the national assembly shall vacant his or her seat in the Assemble, if the member resigns from the political party, which sponsored the member for election to the National Assembly, and becomes an independent or, a member having been elected to the national assembly, as an independent candidate, joins political party, or if a member becomes a member of a political other than the party on whose ticket he was elected to the national Assembly.

The Speaker also took note that Mr Kambwili is on record to have on his own volition, vehemently and unreservedly declared that he runs his own independent political party and that he is in fact the leader of the NDC.

Dr. Matibini says he drew inspiration to reach to the conclusion that Mr Kambwili crossed the floor of the house from the case of Mwamba versus Attorney general of 2016.
