High Court throws out World Vision’s application to restrain Banda

The High Court has thrown out an application for an interim injunction by World Vision to restrain public health expert Beck Banda from publishing or saying anything against the organization.

This is in a matter in which World Vision has sued Dr. Banda for defamation after he accused the organization of infringing the copyright of Safe Motherhood Action Groups (SMAGs), an innovation he claims is his.

When the matter came up before High Court Judge Maria Kawimbe for hearing of the application for an interim injunction, lawyers for the World Vision failed to turn up.

This prompted Judge Kawimbe to throw out the application and ordered that World Vision bears the costs for the application after no explanation was made before her for their absence.

Judge Kawimbe has since adjourned the matter to 29th May, 2019 for scheduling of conference to guide both World Vision and Dr. Banda on dates to prepare for trial of the main matter of defamation.

With this ruling, Dr. Banda is not restrained from complaining against any of the over 40 organizations that uses SMAGs without his express permission.
