Concourt’s decisions, lesson to future petitioners- Chipenzi

GEARS Initiative Executive Director McDonald Chipenzi

GEARS Initiative Executive Director, McDonald Chipenzi says the Constitutional Court’s decisions to overturn High Court rulings  nullifying the elections of some Members of Parliament are lessons to future petitioners.

Mr Chipenzi notes that valuable interpretation of the constitution and pronouncements by the Court has been made which would require serious reflections from citizens and electoral stakeholders, political parties inclusive.

Mr. Chipenzi says the overturning of the High Court’s decision in the Munali and Lusaka Central petitions is a wakeup call to re-look at the current electoral law, before electoral violence, corruption and malpractices are institutionalized in the electoral process.

He notes that the Constitutional Court’s rulings may entrench electoral violence as they do not punish perpetrators of electoral violence.

The Constitutional Court has declared Professor Nkandu Luo as duly elected Munali Member of Parliament just weeks after it upheld Lusaka Central Member of Parliament Margaret Mwanakatwe’s election.
