A manager at the Patents and Companies Registration Agency (PACRA) has told the Lusaka Magistrate Court that how he discovered documents lodged with his office notifying the Agency’s Registrar of changes made to the particulars of the Directors of Mwamona Engineering and Technical Services Limited the day he was supposed to testify in court on 6th March,2018.
This is in the case in which Roan Member of Parliament Chishimba Kambwili is charged with three counts of forgery,uttering false documents, and presenting false document to a public officer.
Lawrence Mwenya 43, told the court that the documents included a resolution by Mr. Kambwili and the company’s two other directors Mwamba Chishimba and Carol Chishimba to allegedly change Mwamba’s National Registration Card particulars, from what had been submitted during the company’s incorporation in 2001.
Mr. Mwenya says it is was at this point that he informed Police officers who were investigating Mr. Kambwili’s matter because he found it surprising, considering that the documents were found in his office the time he was supposed to testify in the matter, on documents that existed from the time the company was incorporated.
But during cross examination Mr. Mwenya told the court that there was nothing illegal in the changes which were approved by the owners of the company.
Asked by defence counsel Keith Mweemba if the accused had forged any documents according to the indictment, Mr Mwenya said it was impossible that the Roan MP could forge the documents as everything he did was within the confines of the law.
Asked further if there was anything illegal to the changing of particulars of any of the Mwamona Engineering directors, Mr. Mwenya said there was nothing illegal, because owners of companies registered under PACRA can regularize their particulars at any given time.
Magistrate Simusamba has since adjourned the matter to 14th June, 2018 for continued trial.
Economic and Equity party leader Chilufya Tayali reported Roan Member of Parliament Chishimba Kambwili to the authorities alleging that he forged particulars of the Directors of Mwamona Engineering and Technical Services Limited.
