Lusaka High Court Judge Edward Musona has authenticated video evidence which contributed to the nullification of the election of Higher Education Minister, Professor Nkandu Luo as Munali Member of Parliament following a petition filed by losing UPND candidate Doreen Mwamba.
The Constitution Court has referred back the matter to the High Court for Justice Musona to confirm the authenticity of the video by viewing it.
This follows Professor Luo’s decision to challenge the nullification of her election in the Constitutional Court.
Justice Enock Mulembe sitting with Justices Annie Sitali and Mulenga Mungeni told the parties that the court cannot dismiss the petition entirely without taking into consideration the circumstances that surround the missing video evidence.
And when the matter came up for ruling today, Judge Musona said he had previewed the video in an open court on 20th March, 2018 and is satisfied that material evidence upon which he based his decision to nullify the Munali parliamentary seat is still intact and confirmed that the video is authentic.
And 2016 losing UPND parliamentary candidate for Munali constituency Doreen Mwamba says the ruling was expected.
She says the Munali parliamentary election was marred by violence.
Efforts to get a comment from Professor Luo proved futile.
