HH,GBM seek Judge Chitabo’s recusal

HH,GBM,CBUPND President Hakainde Hichilema and his vice Geoffrey Mwamba have filed an application asking High Court judge Mwila Chitabo to recuse himself from handling their case relating to the presidential petition.

Judge Chitabo has since adjourned the matter to tomorrow, 16th March to allow him study the application and for the lawyers for the respondents to reply to the application.

Mr. Hichilema contends that Judge Chitabo conducted himself in a compromised manner in the wake of clashes between UPND supporters and police at the court grounds.

Mr Hichilema and Mr Mwamba proceeded to write to Chief Justice Ireen Mambilima seeking Judge Chitabo’s recusal from the matter.

During the last hearing, Attorney General Kalaluka had asked the court to throw out the UPND case on account of jurisdiction.

He argued that the matter before the High Court was of a constitutional nature and thus should be thrown out.

Both Mr Hichilema and Mr Mwamba were not at court when the matter came this morning.
