Justice Minister Ngosa Simbyakula has been challenged to guide the nation on what the legal implication of subjecting article 79 to the August 11 referendum will be.
Dr. Simbyakula is being asked to clearly tell the nation what it will mean for this Article if the threshold of for a successful referendum is met, yet either the ‘No or Yes vote surpasses the other.
Electoral expert Macdonald Chipenzi says the Law Association of Zambia (LAZ) should also give its legal understanding of what will happen if more people vote Yes or No in the referendum.
Mr. Chipenzi says this is particularly that in the manner in which the Article 79 and the referendum Act itself have been crafted, it remains ambiguous what happens if people vote Yes or No.
He says there is need for lawyers to explain to the nation whether merely meeting the threshold for the referendum will also mean that Parliament can now pass the Bill of Rights.
