K14 billion DBZ debt retrial cut short

The retrial in the matter in which Directors of the defunct Zambian Airways were ordered to pay K14 billion debt to the Development Bank of Zambia was this morning cut short after anomalies were noticed in the contents of the amended statements of claim and writ of summons filed before the High Court.

High Court Judge Justine Chashi was due to hear testimonies from the complainant’s witnesses when it was noticed that no amendments were made to the writ of summons despite the statement of clHigh Courtaim filed on the 3rd of June this year before court having been amended.

Judge Chisha then asked lawyer representing the DBZ Buta Gondwe to make amendments to the writ of summon with conditions that the amended writ of summons be filed before the court today Tuesday, 28th April.

The Judge also gave both parties two days in which to make amendments to their witnesses’ statements recorded from the earlier proceedings when the matter was being handled by Judge Albert Wood.

This was after a consent agreement was enter into by the Directors of the defunct Zambian Airways who are suspended Director of Public Prosecutions (DPP) Mutembo Nchito, Post Newspaper owner Fred M’membe and Nchima Nchito and the DBZ counsel.

Judge Chashi has however given conditions that all amendments made to the statements of witnesses be made within the confines of the bundles of documents already before Court.

The matter has since been adjourned to Thursday 30th April for continuation of retrial.
