Supreme Court adjourns Nevers suspension case

 

 

Nevers-Mumba-at-supreme-courtThe Supreme Court has adjourned to tomorrow, Tuesday, 16th December the matter in which MMD President Nevers Mumba has asked the Court to reserve the High Court’s decision to throw out an earlier granted ex parte injunction that allowed him to continue performing the functions of MMD president.

When the matter came up this morning before the court, lawyer representing MMD National Secretary Muhabi Lungu, Abyud Shonga asked the court to adjourn the matter owing to the fact that the notice of appeal by the appellant Dr. Mumba was communicated to the respondent late.

Mr. Shonga has told the court that his client had only been served with the notice of appeal this morning and therefore did not have enough time to study the arguments on which he was to base his heads of arguments.

Mr. Shonga argued that his client also needed to raise preliminary issues before filing his heads of arguments, but that given the circumstance; he will have to include the preliminary issues in his heads of argument which are to be submitted to court tomorrow before the matter is head.

Acting Chief Justice Lombe Chibesakunda who led the full Supreme Court bench adjourned the matter to 11:30hrs tomorrow.

And speaking shortly after the adjournment, Dr. Mumba called on his supporters who came to give him solidarity outside the court premises to remain calm.

Dr. Mumba has assured his supporters that as party president he will always do what is right.

He says as long as he is MMD president there will be no compromise with regards respecting the provisions of the party constitution.

Dr Mumba has also disclosed that he habours no hatred for MMD National Secretary Muhabi Lungu despite what has transpired in the party.

He says he considers Mr. Lungu as his own son because he is the one who has brought him up to the level he is toady as MMD National Secretary.

Meanwhile the Supreme Court is this afternoon expected to deliver ruling in the matter in which Matero Member of Parliament Miles Sampa has challenged the declaration of Edgar Lungu as the duly elected PF President.
