Chief Mpezeni sued over failed Mukula tree deal

A Lusaka businessman has sued Paramount Chief Mpezeni whose name is Davison Jere together with his two nephews claiming a full refund of US$127,000 which was payment for the Mukulu tree.

According to a statement of claim filed in the Lusaka High Court Registry obtained by QFM , Richard Sikwibele Mwapela has sued Chief Mpezeni,Mathias Puta and Danny Mwanza as first,second and third defendants respectively.

Mr Mwapela claims in his statement that Chief Mpezeni told him that he sells Mukula tree and that he has a license to export and transport the Mukulu tree.

He says he therefore agreed to buy the Mukula tree from Chief Mpezeni based on the assurance he had been given by chief mpezeni that he had the export license,he proceeded to pay the Paramount Chief US$87,000 which the second defendant counted and was given a share by the Chief in his presence.

Mr Mwapela adds that the third defendant Danny Mwanza who was also introduced as Chief Mpezeni’s nephew and a transporter was given a contract to transport the Mukula tree and that he went on to pay him a further US$40 for the transportation services.

He states that after the defendants were paid in full and the trucks loaded with the Mukula tree, he was informed by Chief Mpezeni that infact he did not have the license to sell and export the Mukula tree.

Mr Mwapela says after trying several times to get Chief Mpezeni to secure the license, he only heard after more than one month that the Chief Mpezeni had sold the same Mukula tree to someone else.

He says the defendants have refused to refund him the money despite being reminded repeatedly.

Mr Mwapela is claiming the full refund, damages interest and costs.
