Supreme Court did not reinstate Nevers – Nakachinda

The Felix Mutati led MMD faction says yesterday’s Supreme Court ruling has been twisted to create an impression that Dr. Nevers Mumba has been reinstated as MMD President.

Briefing Journalists in Lusaka this morning, faction National Secretary Raphael Nakachinda says the Supreme Court merely referred the matter back to the High Court for retrial and did not reinstate Dr. Mumba.

Mr. Nakachinda explains that Dr. Mumba, through Ms Winnie Zaloumis attempted to introduce new evidence in their appeal case in the Supreme Court and which was dismissed.

He says Dr. Mumba’s team then opted to apply to have the matter referred back to the High Court to which Mr. Mutati’s lawyers did not object in order to allow Dr. Mumba exhaust his right to be heard.

He adds that the challenge on the recognition of Mr. Mutati and his entire leadership as office bearers by the Registrar of Societies was not interfered with by the Supreme Court.

But Spokesperson for the Nevers Mumba led faction Irene Musonda has warned Mr Nakacinda that heIRENE MUSONDA risks being cited for contempt if he continues to comment on any MMD matter as he remains suspended from the party.

She says Mr Nakachinda has no mandate to comment on any matter related to the MMD.

Ms Musonda says the party will not tolerate Mr Nakacinda’s lawlessness and has strongly advised him to stay away from all MMD matters pending the issuance of a new court order by the Lusaka High Court.
