Tayali welcomes discontinuation of Nchito’s case

Tayali CThe Zambian Voice has welcomed the decision by Lusaka Magistrate Lameck Mwale to discontinue the case in which Director of Public Prosecutions (DPP) Mutembo Nchito was facing criminal charges.

Executive Director Chilufya Tayali says the letter and spirit of the law is clear that a sitting DPP cannot and must not be prosecuted.

In a statement to Qfm News, Mr. Tayali however notes that this does not mean that a DPP has immunity which is explicit in the constitution.

Mr. Tayali states that with the aforesaid, it now remains for President Edgar Lungu to setup a tribunal according to article 58 of the constitution of Zambia.

He says this is because the situation country is currently in clearly satisfies the conditions of invoking article 58 by President Lungu.

Mr. Tayali notes that failure to do so will render injustice to the DPP who has been accused because he will not have an opportunity to clear himself of the allegations.

He says the allegations and publicity of the offenses against Mr Nchito has brought the office of the DPP into ridicule and disrepute and therefore the President has the obligation to protect the DPP’s office.
